Supervisory Function

Exercised by the Monitoring Division and in accordance with number 2 of article 2.1.1.3 of the Regulation "It consists of verifying compliance with the rules, regulations and other provisions applicable to the markets managed by the member brokerage firms and the natural persons linked to them, based on the investigation of the facts and behaviors carried out, in order to determine the disciplinary responsibility for the breach of the aforementioned regulations.”

The tasks of the Monitoring Division are defined in article 2.2.1.2. of the Regulations, highlighting the provision in numeral 12 of the Regulations, according to which the Head of the Division must "Receive and attend to the claims submitted by the principals, clients and investors of the member brokerage firms, in accordance with the procedure for dealing with complaints and claims that the Stock Exchange adopts through a Circular.”

Complaints and reports

Below you will find the Complaints and Reports Form designed to submit complaints and reports against members and their affiliates. However, there are three other ways through which you can present them to the Monitoring Area:

In accordance with the provisions of article 2.1.2. of the Sole Circular of the BMC, the facts that may be the subject of complaints and reports before the Monitoring Division are those related to possible breaches by the brokerage firms or the people linked to them, of the market regulations applicable to them.

It is noted that the complaint or report will not be processed when it is not related to compliance with the market regulations applicable to the brokerage firms or the people linked to them or when it is a matter of a civil, labor or criminal nature, event in which the complainant or reporter must complete the relevant procedures before the ordinary justice system or competent bodies.

Likewise, it is stated that when the complaint or report contains matters related to (i) intervening in the course of judicial processes, (ii) ordering the return of money and (iii) ordering the payment of compensation, the Monitoring Division will not process said matters, as it lacks jurisdiction to do so.”
